Acceptance of Terms

These Terms and Conditions ("Terms") govern the relationship between Royal Tours Vacations ("the Company", "we", "us", "our") and any individual or group ("the Client", "you", "your") who makes an inquiry, reservation, or booking for any service offered by Royal Tours Vacations.

By accessing our website at royaltoursvacations.com, making an inquiry, submitting a booking, or participating in any tour, transfer, or event organised by Royal Tours Vacations, you confirm that you have read, understood, and agree to be bound by these Terms in their entirety.

If you are booking on behalf of a group or third party, you represent and warrant that you have the authority to accept these Terms on behalf of all members of your party, and that all members are aware of and agree to these Terms.

Definitions

In these Terms and Conditions, unless the context otherwise requires:

• "Booking" means a confirmed reservation for any service offered by Royal Tours Vacations, including tours, excursions, transfers, and wedding packages.
• "Services" means all tours, excursions, airport transfers, wedding and honeymoon packages, and any ancillary travel services arranged or provided by Royal Tours Vacations.
• "Client" means the individual or group making a booking and all persons included in that booking.
• "Lead Passenger" means the primary contact person who makes the booking on behalf of a group and accepts responsibility for all members of the party.
• "Tour Date" means the scheduled date of departure or commencement of the booked service.
• "Supplier" means any third-party service provider, including but not limited to hotels, ground transportation operators, activity providers, and airlines, engaged to deliver elements of the service.
• "Force Majeure" has the meaning given in Section 09 of these Terms.

Booking Contract

Formation of Contract

A binding contract between you and Royal Tours Vacations is formed only when:

1. You have submitted a completed booking request with accurate personal and payment details;
2. We have received your required deposit payment in full; and
3. We have issued you a written booking confirmation via email.

Prior to the issuance of a written confirmation, no contract exists and no services are guaranteed. Royal Tours Vacations reserves the right to decline any booking at its sole discretion.

Accuracy of Information

You are responsible for ensuring that all information provided at the time of booking is accurate and complete, including names, contact details, travel dates, and special requirements. Royal Tours Vacations is not liable for any losses or additional costs arising from errors in the information you provide.

Lead Passenger Responsibility

Where a booking is made for a group, the Lead Passenger accepts full responsibility for ensuring that all members of the party comply with these Terms and Conditions. The Lead Passenger is jointly and severally liable for all payments and cancellation charges applicable to the group.

Pricing & Payment

Currency & Pricing

All prices are quoted in US Dollars (USD) unless otherwise stated. Published prices are subject to change without notice prior to booking confirmation. Once a booking is confirmed in writing, the price is fixed and will not be subject to increase, except in the event of significant changes in government-imposed taxes or duties that directly affect the service cost.

Payment Schedule

• A non-refundable deposit of 30% of the total booking cost is due at the time of booking to confirm your reservation.
• The remaining balance is due no later than 30 days before the Tour Date.
• Bookings made within 30 days of the Tour Date require payment in full at the time of booking.

Accepted Payment Methods

We accept Visa, Mastercard, American Express, bank transfers, and approved digital payment platforms. Payment must be received and cleared before a booking is confirmed. We do not accept cash payments remotely. Payments are processed via a secure, encrypted payment gateway. We do not store full card details.

Price Inclusions & Exclusions

Unless explicitly stated in writing in your booking confirmation, the following are not included in any quoted price:

• International or domestic flights
• Travel insurance
• Passport and visa fees
• Personal spending money, tips, and gratuities
• Meals and beverages not specified in the itinerary
• Any item of a personal nature

Client Obligations

By making a booking with Royal Tours Vacations, you agree to the following obligations:

• Provide accurate and complete information at the time of booking and promptly notify us of any changes.
• Arrive at the designated meeting point at the confirmed time. Failure to do so may result in the tour departing without you, with no entitlement to a refund.
• Comply with all safety briefings, instructions, and guidelines issued by our guides, drivers, and activity operators.
• Respect the laws, customs, and cultural norms of Jamaica and any destination visited.
• Behave in a manner that is safe, courteous, and respectful toward other clients, our staff, and the local community.
• Ensure that all members of your group, including minors, comply with these Terms and Conditions.
• Accept that certain activities carry inherent physical risk and that you participate at your own discretion and risk.

Travel Documents & Entry Requirements

It is the sole responsibility of the Client to ensure that all members of their party hold valid travel documentation required for entry into Jamaica and any other destination featured in the itinerary. This includes:

• A valid passport with at least six (6) months of validity beyond the return travel date
• Applicable visas and entry permits
• Proof of onward travel or return tickets
• Required vaccination certificates or health documentation

Royal Tours Vacations will communicate known entry requirements as a courtesy, but we cannot guarantee the completeness or accuracy of third-party government requirements, which may change at any time without notice. We strongly recommend checking with the relevant embassy or consulate and the official Jamaican government travel portal prior to travel.

Failure to hold valid travel documents will not entitle the Client to a refund of any booking costs.

Health & Physical Fitness

Certain tours and activities offered by Royal Tours Vacations require participants to meet minimum health and fitness standards. By booking an activity, you confirm that all participants are in good physical health and are capable of participating safely.

Disclosure Requirements

You must disclose at the time of booking any medical condition, disability, pregnancy, or physical limitation that may affect your ability to participate in booked activities. This information is used solely to ensure your safety and comfort. Failure to disclose relevant medical information may affect our ability to assist you and may, in certain circumstances, require us to deny participation in a specific activity for safety reasons.

Medical Events During a Tour

In the event of a medical emergency during a tour, our guides will take all reasonable steps to assist and will contact emergency services where required. Any costs associated with medical treatment, evacuation, or repatriation are the sole responsibility of the Client. This is another reason why comprehensive travel insurance is strongly recommended.

Liability & Indemnity

Limitation of Liability

Royal Tours Vacations acts as a booking agent and coordinator for independent third-party service providers. To the fullest extent permitted by applicable law, Royal Tours Vacations shall not be liable for:

• Any death, personal injury, illness, loss, or damage to property caused by the acts or omissions of any third-party supplier
• Service failures, delays, or disruptions caused by third-party operators, weather, or other factors beyond our direct control
• Any indirect, consequential, or special loss or damage arising from a booking or the use of our services
• Any loss arising from the Client's failure to comply with these Terms or applicable travel document requirements

Where liability cannot be excluded by law, our total liability to you in connection with any single booking shall not exceed the total price paid by the Client for that booking.

Client Indemnity

The Client agrees to indemnify and hold harmless Royal Tours Vacations, its directors, employees, agents, and representatives from and against any claims, losses, damages, fines, penalties, or legal costs arising from:

• Any breach of these Terms by the Client or any member of their party
• Any act or omission by the Client or their party that causes loss or damage to Royal Tours Vacations, third parties, or property
• Any misrepresentation or inaccuracy in information provided at the time of booking

Force Majeure

Royal Tours Vacations shall not be liable for any failure or delay in performing its obligations under a booking contract where such failure or delay results from circumstances beyond our reasonable control ("Force Majeure Events"). Force Majeure Events include, but are not limited to:

• Acts of God, including hurricanes, earthquakes, floods, volcanic eruptions, and other natural disasters
• Epidemics, pandemics, or public health emergencies declared by a national or international authority
• War, terrorism, civil unrest, riots, or political instability
• Government actions, travel bans, border closures, or mandatory quarantine requirements
• Industrial action, strikes, or widespread transportation failures
• Failure of essential utility services

In the event of a Force Majeure cancellation by Royal Tours Vacations, the Client will be offered a full credit or full refund in accordance with our Refund Policy. Royal Tours Vacations shall not be liable for any additional costs incurred by the Client as a result of a Force Majeure Event, including but not limited to flight changes, accommodation costs, or additional travel expenses.

Client Behaviour & Right to Remove

Royal Tours Vacations is committed to providing a safe, enjoyable, and respectful experience for all clients and staff. We reserve the right to refuse service to, or remove from a tour, any Client whose behaviour is deemed to be:

• Threatening, abusive, violent, or harassing toward staff, guides, or other guests
• Disruptive to the safe and orderly conduct of a tour or activity
• In violation of local laws or regulations
• Endangering the safety of themselves or others
• Under the influence of alcohol or controlled substances to a degree that poses a safety risk

A Client removed from a tour for behavioural reasons will not be entitled to any refund for the unused portion of their booking. Royal Tours Vacations shall not be responsible for any additional costs or losses incurred by a Client as a result of their removal.

Any damage caused to vehicles, equipment, or property by a Client will be charged directly to that Client and pursued through legal channels if necessary.

Intellectual Property

All content published on the Royal Tours Vacations website and in our marketing materials — including but not limited to written content, photographs, video, graphics, logos, tour itineraries, pricing structures, and branding — is the exclusive intellectual property of Royal Tours Vacations or our licensed content partners and is protected by applicable copyright law.

You may not reproduce, republish, distribute, commercially exploit, or create derivative works from any content without prior written authorisation from Royal Tours Vacations. Unauthorised use constitutes an infringement of our intellectual property rights and may result in civil or criminal proceedings.

User Content

By submitting photographs, videos, reviews, or testimonials to Royal Tours Vacations through any channel, you grant us a non-exclusive, royalty-free, perpetual, and worldwide licence to use, edit, and publish that content in connection with our marketing, website, and promotional materials, with or without attribution. You confirm that you own or have the right to submit such content and that it does not infringe any third-party rights.

Third-Party Services & Suppliers

Royal Tours Vacations partners with a range of independent third-party suppliers to deliver elements of its services. While we exercise reasonable care in selecting reputable partners, Royal Tours Vacations does not own or directly operate the services provided by third parties, and we do not guarantee the quality, safety, or performance of third-party services beyond what is reasonably within our control.

Each third-party supplier may have their own terms and conditions, which apply in addition to these Terms. By making a booking that involves third-party services, you acknowledge that those services are subject to the supplier's own terms.

Royal Tours Vacations is not responsible for any claims, losses, or disputes arising directly from a third-party supplier's actions or omissions. Any complaints relating to third-party services should be raised with Royal Tours Vacations in writing within 30 days of the tour date.

Website Use

The Royal Tours Vacations website is provided for informational and booking purposes. By using our website, you agree to the following:

• You will not use the website for any unlawful purpose or in any way that violates these Terms.
• You will not attempt to gain unauthorised access to any part of the website, server, or database.
• You will not transmit any harmful, offensive, or disruptive content through the website.
• You will not use automated tools, bots, or scrapers to extract data from the website without our prior written consent.
• You acknowledge that the website may contain links to third-party websites for which Royal Tours Vacations is not responsible.

Royal Tours Vacations makes reasonable efforts to ensure the accuracy of information on our website but does not warrant that all content is complete, current, or error-free. We reserve the right to modify, update, or remove any content at any time without notice.

Privacy

The collection and use of your personal data is governed by our Privacy Policy, which is incorporated into and forms part of these Terms and Conditions. By making a booking or using our website, you confirm that you have read and understood our Privacy Policy.

We collect and process personal data only to the extent necessary to provide our services, comply with legal obligations, and communicate with you as described in our Privacy Policy. We do not sell personal data to third parties.

Governing Law & Dispute Resolution

Governing Law

These Terms and Conditions and any dispute or claim arising out of or in connection with them, or their subject matter or formation (including non-contractual disputes or claims), shall be governed by and construed in accordance with the laws of Jamaica.

Dispute Resolution

In the event of a dispute, the parties agree to first attempt to resolve the matter through good-faith negotiation. Written notice of the dispute must be provided to Royal Tours Vacations within 30 days of the event giving rise to the claim.

If a resolution is not reached within 30 days of written notice, the parties agree to proceed to mediation before initiating any formal legal proceedings. Mediation shall be conducted in Jamaica by a mutually agreed mediator. Costs of mediation shall be shared equally unless otherwise agreed.

If mediation fails, both parties irrevocably submit to the exclusive jurisdiction of the courts of Jamaica to settle any dispute or claim.

Severability

If any provision of these Terms is found to be invalid, unlawful, or unenforceable by a court of competent jurisdiction, that provision shall be severed from the remaining Terms, which shall continue in full force and effect.

Entire Agreement

These Terms and Conditions, together with the Privacy Policy, Refund Policy, and any written booking confirmation issued by Royal Tours Vacations, constitute the entire agreement between the parties and supersede all prior representations, agreements, or understandings, whether written or oral.

Amendments to These Terms

Royal Tours Vacations reserves the right to amend, update, or replace these Terms and Conditions at any time. Changes will take effect upon publication on our website. The "Last Updated" date at the top of this page will reflect the date of the most recent revision.

For bookings made prior to any amendment, the Terms in effect at the time of booking confirmation will apply to that booking. For ongoing services, continued use of Royal Tours Vacations' website or services following the publication of updated Terms constitutes acceptance of those changes.
